  1. Information regarding this cash back offer (‘Offer’) and how to claim forms part of these conditions of Offer. By participating in the Offer, claimants accept these conditions. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Consumer Guarantees Act 1993.
  2. Participation in the Offer is open only to New Zealand residents aged 18 years or older (‘Claimants’). Directors, management and employees of the Promoter, its retailers, suppliers and associated companies and agencies as well as the immediate families of each of these people are not eligible to participate in the Offer.
  3. The Offer begins at 12.01am (Auckland time) on 01/01/2017 and closes at 11:59pm (Auckland time) on 30/08/2017 (‘Offer Period’).
  4. To claim, Claimants must, during the Offer Period: 
    1. Purchase from any participating outlet a LISTERINE® TOTAL CARE®, LISTERINE® TOTAL CARE ZERO ™ or LISTERINE® ZERO™  mouthwash from a participating store in New Zealand (‘Eligible Purchase’) (online purchases are not eligible) and retain the store receipt of the Eligible Purchase (‘Store Receipt’).
    2. access and print out the online claim form found at www.listerine.co.nz and complete the form by entering all required details including providing the Claimant’s first name, surname, New Zealand residential street address, contact telephone number, email address, and the last four digits of your Eligible Purchase product barcode and full receipt number; and
    3. send the completed claim form together with a copy of the Store Receipt from the Eligible Purchase to ‘Listerine Money Back, Johnson & Johnson New Zealand, PO Box 56612 Dominion Road, Auckland 1446’.
  5. All claims must be received by the Promoter by 11.59pm (Auckland time) on 15/09/2017. Only one claim is permitted per household during the Offer Period. Any subsequent claim after the first valid claim is received from the same household will be deemed invalid. For the purposes of this Offer, a ‘household’ is deemed to be the residential address stated in a Claimant’s claim form. Multiple claims on the same Eligible Purchase are not permitted. Claimants must retain their original purchase Store Receipts to verify their claim. Failure to provide this verification to the Promoter upon request may, at the Promoter’s discretion, result in an invalid claim.
  6. Incomplete, inaccurate, erroneous, ineligible, late or incomprehensible claims will be deemed invalid. Claims received will be considered final by the Promoter. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
  7. The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
  8. Each Claimant is responsible for paying for the costs associated with participating in the Offer.
  9. Each Claimant must only submit a claim in their own name. All claims become the property of the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
  10. Each valid claim received by 11.59pm (Auckland time) on 15/09/2016 will entitle the Claimant to receive cash back to the value of the price paid for the corresponding Eligible Purchase. The cash back will be provided to the Claimant in the form of a money order payable to the Claimant named on the claim form. Money orders must be deposited by the Claimant into their bank account or cashed by the Claimant within ninety (90) days of the issue date. In the event that, for any reason, a Claimant does not redeem the cash back within the time stipulated by the Promoter, then the cash back will be forfeited by the Claimant.
  11. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, theft, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Offer, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  12. Once any cash back has left the Promoter’s premises, the Promoter and its agencies and companies associated with the Offer will not be responsible for any delay in delivery, loss or damage to the cash back.
  13. Claimants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Offer. If there is a dispute as to the identity of a Claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Claimant. The Promoter may require claimants to verify their claim and provide proof of identity, proof of age, proof of residency at the nominated gift delivery address, proof of purchase, eligibility to participate and claim cash back, and any information submitted by the Claimant in submitting a claim, before issuing the cash back. Identification considered suitable for verification is at the Promoter’s discretion. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a Claimant or claim has not been verified or validated to the Promoter’s satisfaction then the claim may be deemed invalid.
  14. Within 28 days of the Promoter receiving a valid claim that complies with these conditions of entry, the cash back will be mailed directly to Claimant at the New Zealand residential address provided on their claim form.
  15. If a claim is deemed not to comply with these conditions of entry, the claim will be discarded and the claimant will not receive a communication in this regard. No correspondence will be entered into.
  16. The Promoter may verify the validity of claims, and in its sole discretion, disqualify any and all claims from, and prohibit further participation in this Offer by, any person who tampers with or benefits from any tampering with the claim process or with the operation of the promotion or acts in violation of these conditions, acts in a disruptive, unlawful or dishonest manner or acts with the intent to annoy, abuse, threaten or harass any other person or acts in a way to jeopardise the fair operation of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  17. Cash backs are not transferable or exchangeable. Cash backs must be taken as offered, are subject to any supplier conditions and cannot be varied.
  18. If for any reason any aspect of this Offer is not capable of running as planned, including but not limited to, infection by computer virus, mobile network failure, bugs, tampering, manipulation, unauthorised intervention, fraud, state of emergency or disaster, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Offer, the Promoter reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Offer, or invalidate any affected claims.
  19. The Promoter accepts no responsibility for any tax implications that may arise from receiving the cash back.
  20. Claimants’ personal information (‘PI’) will be collected and held by the Promoter (or its related bodies corporate) to enable the Promoter and its agencies to administer and promote this Offer. The PI of Claimants may be provided to third parties assisting in the conduct of the Offer, including suppliers and deliverers, and for publicity purposes surrounding the Offer. If the PI requested is not provided, the claimant may not participate in the Offer. By participating in this Offer the Claimant consents to the use of their PI as described.
